Larry Lessig's Video About Copyright Abuse is Abused using DMCA

If there were anyone out there to whom you would not want to send a random take down notice for an online video, it would probably be Larry Lessig. Given that Lessig has become the public face for those who feel that copyright has been stretched too far, as well as being a founder of Stanford’s Fair Use Project, and who’s written multiple books on these issues, you would think (just maybe) that any copyright holder would at least think twice before sending a DMCA takedown on a Larry Lessig presentation.

If you watch the video it is clearly within the legal limits of Fair Use. Each clip is less than 10 seconds and is used as a quote. Aside from stupidity of Warner Brother activating the The Streisand Effect causing this to go viral, by trying to ban the video they are proving the point the video makes. DMCA is insane!

Lessig makes it clear that the concept of copyrights needs to change. Copyrights are a government granted monopoly. They do not protect artists, and never really have. The big businesses use this government granted monopoly to secure their failing business models while the government wages war on individuals. The same problems that occur in other wars such as innocent victims, wasted money, and corruption occur with the war on sharing. Even though Obama claimed he would protect peoples freedom he lied and appointed an RIAA lawyer to the 2nd most powerful post in the Justice Department.

The problem faced with copyrights stems from the idea of scarcity. Rather than innovate and better serve customers, big business gets the government to use force to protect their monopoly. This is happening with Big Banks, Big Pharma, and Government schools. Any place there is a government granted and enforced monopoly the quality goes down, the cost goes up and innocent people get hurt while a war is waged to protect the profits of the entrenched power group.

There are at least 4 types of business models with countless varieties of each. Two of the types actually benefit from sharing. So this war on sharing is only holding back the bright future that is possible. It won’t stop sharing, it will only drive it underground. Look at how well that approached worked on everything else.

How to secure the IP created from a focus group?

Securing intellectual property is a tricky problem. The growing trend towards open innovation methods makes it even more confusing. In reality what you’re trying to achieve is securing the value you can gather from the intellectual property.

Noted security expert Bruce Schneier points out that the best security is in layers and intelligently handles failures.

Non-disclosure agreements are one way but those often make people unwilling to participate. You can attempt to give members of the focus group some benefit for keeping it quiet. Perhaps offer them some shares for the products? Or maybe just offer future cash payments contingent on it remaining secret? This is the carrot versus the stick of a non-disclosure agreement.

Bruce Schneier has said many times that secrecy can’t be the basis of security. Ideas get out. So you need layers that catch the failures of each other. That way no single failure will penetrate the barrier.

If one focus group can come up with the idea, another would also be able to come up with that idea. So instead of using focus groups to get ideas of ??how?? to solve a need use the focus group to accurately understand ??what?? will satisfy their need. A product or service is a ??how??. The customers don’t really care about ??how?? they just want their needs satisfied.

The specific ??how?? ideas that come from a focus group help you better understand ??what?? they are trying to accomplish and ??what?? will satisfy their needs. Its the innovators job to find the best ??how?? ways to satisfy all their needs related to the task they are trying to perform.

Using that technique you can uncover ALL the ??how?? ways to satisfy the needs for the task. With that information it is possible to then develop a layered approach to securing your intellectual property. One part of that can include patents.

3D Printer Brings Vision to the Poor

The same week that I found all the articles on 3D printers I found an amazing example that could dramatically improve life for billions of people in developing countries who cannot access, nor afford, prescription glasses.

Last weekend I went to get a new optical prescription so I could buy new contacts. The technician used fully automatic devices to check me for glaucoma and calculated my prescription. I had experienced the glaucoma device but the prescription device was new to me. I instantly knew how it worked just from seeing it. The machine reflects a pattern off your eye then adjusts lenses in the device until the reflected pattern matches the original. Incredibly, quick easy and cheap!

My mind raced through all the potential innovations stemming from this device. I came up with a long list which I’ll get to in a moment. What I am more excited about is an extremely innovative application of this same technique. In 2002 a student at MIT used a similar technique as part of a system to make glasses for the poor. This was exactly what I had thought of. This innovation went from an idea in 2002 to commercial usable device in 2006. That is amazing.

One of the reasons the idea was developed in such a short time was the use of a 3D printer to create a prototype. But probably even more important was it solved a previously impossible problem and opened up a gigantic market. There are 1 billion people who need inexpensive glasses. Market for low cost glasses
